Article 1 — Application

These Terms of Service (“Terms”) apply to all use of the online store and related services operated by PONODOG (collectively, the “Services”).

PONODOG may separately establish a Privacy Policy, Return Policy, and other policies in addition to these Terms. Such policies shall form part of these Terms.

Article 2 — Prohibited Activities

Users must not engage in any of the following activities when using the Services:

  • Any activity that violates applicable laws, regulations, or public order and morals
  • Impersonating another person
  • Infringing the rights or interests of PONODOG or any third party
  • Providing false information
  • Unauthorized access to, alteration of, destruction of, or similar interference with systems or networks
  • Interfering with the operation of the Services
  • Purchasing products for resale, redistribution, or other commercial purposes
  • Any other activity that PONODOG deems inappropriate

Article 3 — Order Information and Information Management

Users are responsible for providing and maintaining accurate information.

If any order information is false, incomplete, or incorrect, PONODOG may cancel the order or take other measures as necessary.

Minors may use the Services only with the consent of their parent or legal guardian.

Article 4 — Purchase of Products

Users may purchase products displayed through the Services.

Orders cannot be modified or canceled once they have been confirmed.

Product colors, textures, and other characteristics may appear different from the actual product depending on the device, display settings, or viewing environment.

Although we take reasonable care in managing inventory, an item may become unavailable depending on the timing of your order.

Article 5 — Payment Methods

Payment shall be made by credit card or any other payment method separately specified by PONODOG.

Payment timing and applicable conditions shall be subject to the terms established by the relevant payment service provider.

Article 6 — Shipping

Shipping carriers will be selected by PONODOG.

Shipping fees are specified separately on our “Shipping & Delivery” page.

Delivery may be delayed due to weather conditions, traffic conditions, carrier circumstances, force majeure, or other circumstances beyond our reasonable control.

Article 7 — Returns and Exchanges

Returns and exchanges shall be handled in accordance with our separately established “Return Policy.”

Article 8 — Intellectual Property Rights

All copyrights and other rights relating to images, photographs, text, designs, logos, product information, videos, and all other content made available through the Services belong to PONODOG or their respective lawful rights holders.

Without the prior permission of the relevant rights holder, users may not reproduce, republish, copy, modify, redistribute, reuse screenshots of, post on social media, e-commerce websites, marketplace services, or other third-party media, use for advertising purposes, use for AI training, or otherwise use all or any part of such content in a similar manner.

If PONODOG becomes aware of unauthorized use or other infringement of its rights, PONODOG may take appropriate action, including requesting that the content be removed, submitting a takedown request, seeking damages, or pursuing other legal remedies.

Article 9 — Disclaimer

Except in cases of willful misconduct or gross negligence by PONODOG, PONODOG shall not be liable for damages arising from or related to the use of products or the Services.

Except in cases of willful misconduct or gross negligence by PONODOG, PONODOG shall not be liable for damages resulting from defects in the Services, system failures, communication failures, or similar circumstances.

PONODOG shall not be liable for delays or disruptions caused by natural disasters, accidents, communication failures, or other events of force majeure.

Article 10 — Changes to These Terms

PONODOG may amend these Terms when it determines that such amendments are necessary.

The amended Terms shall become effective when posted through the Services.

Article 11 — Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any dispute arising out of or in connection with the Services shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
